Agreement to terms
By creating an account or using Baybook, you agree to these terms. If you don't agree, don't use the platform. These terms form a binding agreement between you and Adam Rosato (ABN 25 841 671 229), trading as Baybook Australia.
About Baybook
Baybook is a compliance management platform for vehicle hoist inspections under Australian Standard AS 2550.9:2024. The platform connects service providers (inspection companies) with workshops (hoist operators) to manage inspection scheduling, record-keeping, and certificate generation.
The platform is a record-keeping and management tool — it does not provide inspection services, engineering advice, or replace professional judgment.
Platform purpose and limitations
Baybook is a record-keeping and compliance management platform. It helps service providers document inspections and helps workshops track the status of their hoists. That's what it does — no more, no less.
Baybook does not:
- Conduct inspections or provide inspection services
- Act as a regulatory body or certifying authority
- Provide engineering, structural, or safety advice
- Guarantee the safety or fitness for purpose of any equipment
- Replace the professional judgment of qualified inspectors
Inspection certificates generated through Baybook are based entirely on data entered by the service provider's inspectors. The platform formats and stores this data — it does not independently verify or validate inspection findings.
Your responsibilities:
- Workshops must act promptly on any defects identified during inspections or pre-start checks
- Operators must complete daily pre-start checks as required by AS 2550.9 before using any hoist
- Workshops must maintain hoists between inspections in accordance with manufacturer requirements
- An “inspection current” status on the platform means scheduled inspections are up to date — it does not mean the hoist is guaranteed safe for use at any given moment
Account types and responsibilities
Service providers are responsible for the accuracy of inspection records, checklist responses, and measurements entered into the platform. Inspection certificates generated through Baybook reflect the data entered by the provider's inspectors.
Workshops are responsible for ensuring hoists are available for scheduled inspections, completing daily pre-start checks as required by AS 2550.9, and maintaining accurate hoist information.
All users: Keep your login credentials secure. You're responsible for all activity under your account. Notify us immediately if you suspect unauthorised access.
Inspection records and certificates
Certificates generated by Baybook are based on data entered by the service provider's inspectors. Baybook does not independently verify inspection results.
The platform generates certificates in the format and with the information required by AS 2550.9:2024, but the accuracy of the underlying data is the responsibility of the qualified inspector.
Completed inspection records and certificates are immutable — they can't be edited or deleted after completion to maintain compliance integrity.
Acceptable use
You agree not to:
- Enter false or misleading inspection data
- Share your login credentials with unauthorised persons
- Attempt to access data belonging to other organisations
- Use the platform for any purpose other than hoist compliance management
- Reverse engineer, decompile, or attempt to extract the source code
- Use automated tools to scrape or extract data from the platform
Intellectual property
The platform, its design, code, and documentation are owned by Baybook Australia. Your inspection data, photos, and compliance records remain your property.
By using the platform, you grant us a licence to store, process, and display your data as necessary to provide the service.
Availability and support
We aim to keep Baybook available and reliable, but we don't guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We'll try to notify you of planned maintenance in advance.
The platform is provided as a cloud service — you need an internet connection to use it.
Limitation of liability
To the maximum extent permitted by Australian Consumer Law:
- Baybook is provided “as is” without warranties beyond those implied by law
- We are not liable for any loss arising from reliance on inspection records or certificates generated through the platform — the qualified inspector is responsible for inspection accuracy
- We are not liable for any indirect, consequential, or incidental losses
- Our total liability is limited to the fees you've paid us in the 12 months before the claim
- Nothing in these terms excludes or limits consumer guarantees under the Australian Consumer Law that cannot be excluded by law
Suspension and termination
We may suspend or terminate your account if you breach these terms, particularly if false inspection data is entered. You can close your account by contacting us.
On termination, your access to the platform ceases, but we may retain compliance records as required by workplace safety regulations (see our Privacy Policy).
Changes to these terms
We may update these terms from time to time. Material changes will be communicated through the platform. Continued use after changes constitutes acceptance.
Governing law
These terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any disputes will be subject to the jurisdiction of the courts of Western Australia.
